The Peruvian government defines extradition as “a mechanism for international judicial cooperation, which allows a State to formally request another to hand over a defendant or convicted of a common crime, to prosecute him criminally or execute the sentence that may have been imposed.” This process could last several months, according to the former Minister of Women and Vulnerable Populations, Rosario Sasieta.

On Tuesday, through a statement, the Ministry of Foreign Affairs of Peru indicated that, since his capture in Colombia, the fiscal and diplomatic authorities exhaustively examined all possible alternatives that would allow the delivery of the Venezuelan citizen to Peru. Sergio Tarache in the most expeditious and safe way possible. However, Tarache will not be expelled to Peru, but an extradition process will begin.

The ministry added that the procedures for the extradition of tarache They were initiated last Friday, April 14, by the 24th Preparatory Investigation Court of the Superior Court of Justice (CSJ) of Lima, which asked to inform “the pertinent authorities via diplomatic means of the preventive detention order” against the accused.

It should be noted that the Colombian authorities determined that preventive detention for extradition purposes is the best way to provide greater guarantees and an effective administration of justice.

At the beginning of March, the Public Ministry began the extradition process for Pamela Cabanillas Sanchez, who is detained in Spain, for the alleged commission of the crimes of aggravated fraud and others related to the sale of tickets for the concerts of Daddy Yankee, Bad Bunny, Morat, Coldplay and various soccer matches.

The institution announced this measure against the Peruvian citizen, who is being held in preventive detention for 18 months and who was arrested on March 1 in Madrid, Spain, thanks to a coordinated action between Interpol Peru, Italy and Spain, which located the whereabouts of the fugitive from Peruvian justice.

On February 14, the Judiciary ordered the national and international capture of cabanillas as the alleged perpetrator of the crime of fraud, identity theft and falsification of documents, which have a maximum custodial sentence of 8, 4 and 5 years, respectively.

A case with more years, and that would be about to culminate is the extradition process of the former president Alexander Toledo. In September 2021, the United States justice system decided that the former Peruvian president could be extradited and considered that there is evidence of the existence of a criminal act and considered it sufficient to support the accusations of conspiracy and money laundering.

On April 5 of this year, Judge Thomas Hixson ordered his arrest to proceed with his extradition to Peru. However, Toledo’s defense filed new appeals to reconsider the resolution of a US judge.

Despite this, due to a new request raised this Tuesday from the United States Attorney General’s Office to the California judge, Thomas S. Hixson, Toledo must be arrested to execute his extradition to Peru, which could be given in the coming days, culminating a process that began in December 2017.
