The block of councilors of the Frente de Todos presented this Thursday a request for reports on the actions carried out by the Municipality of La Plata before the publication of subdivisions by well-known real estate agents in the city in the protected area of ​​Arroyo El Pescado in breach of ordinances 12,150 and 12,079.

It is a project of the president of the block, Yanina Lamberti, and that bears the signatures of all the councilors of the Frente de Todos. In the fundamentals of the order it is explained that the real estate companies are publishing, “through the Zonaprop and Argenprop pages, plots of land with values ​​ranging from 8,000 to 45,000 US dollars, flagrantly violating ordinances 12,150 and 12,079.”

They add that to this situation “In addition, the Municipality is advancing with the opening of Calle 19 between 670 and 673, on the wetland of Arroyo El Pescado, contradicting Ordinance 12079, on the Area of ​​Heritage Value”.

Councilor Yanina Lamberti explained that “when one travels through the Sicardi area, specifically from 670 to 673, you can see a series of real estate agencies that advertise subdivisions. This is completely illegal, because after 670 it is an area where it is established by an ordinance approved in 2020 that no construction can be carried out beyond 670 and that, if it is done, it must be approved. by the Deliberative Council”.

Article 6 of ordinance 12,150 establishes that “lots, urbanizations, or any type of urban developments that have not obtained the approval of the geometric face of the project, where streets to be transferred, reservations, restrictions, formation of massifs, may not be published. and eventually, its division within the framework of the respective municipal file and that does not fall within the current provincial regulations. To this end, the publicity that is carried out in compliance with the previous paragraph, must include, obligatorily, the proof of obtaining the Provincial Hydraulic Pre-feasibility Certificate, municipal file number and name of the undertaking. The Executive Department will promote actions both before the Justice of Faults, as before the professional associations that incur in this irregularity”.

“Allowing this situation is to encourage a deception to the neighbors who want to buy a piece of land to build their house there, also knowing that it is a place where no type of construction will be possible,” Lamberti said.

At this point, the councilor considered that Mayor Julio Garro is validating the sale of lots in areas where houses cannot be built: “The sale of lots in the protected area of ​​Arroyo el Pescado is worrying. Far from denouncing these irregularities, it seems to act the other way around”.

“It seems to us that the Municipality has to be very clear in this situation, for this reason we are requesting reports where we show all the advertisements for the sale of land, and we also want to alert the neighbors about such a situation, to that they do not buy lots in that area, since they will not be able to build”, concluded Lamberti.

THE RESPONSE OF THE MUNICIPALITY

Days ago, The Municipality of La Plata ratified the ban on private construction in the Arroyo El Pescado wetland and announced that the opening of ceded streets for public use is being developed, but without affecting the protected area. They also specified that in the last year, more than 100 clandestine real estate developments were prevented in the area.

“The current ordinance, proposed and approved by this management in 2021, prohibits the development of urbanizations in the area because it is a protected area”explained the secretary of Urban Planning of the Commune, Maria Botta.

In this context, he reported that the Municipality recently authorized the opening of Calle 19 between 670 and 672 to improve connectivity for residents of a sector of the Sicardi Parkwhere homes were built for decades past and today requires appropriate road infrastructure.

“This opening of a street is something completely different that does not imply an urbanization, does not affect the protected area and favors the connectivity of the sector”added Botta.

In this regard, it was specified that before the request to open the aforementioned artery, the Commune verified through a report from the municipal Cadastre area that it has been ceded to public use for many years, that its opening complies with current regulations and that, in no way, affects the wetland.

In this sense, the official highlighted: “During the year 2022, we completed more than 100 closures and contraventions against clandestine real estate developments in protected areas of Arroyo El Pescado. Taking into account the concern of the neighbors, we are going to reinforce the signage indicating the limits that prohibit construction according to current ordinances”.
