The president of the supreme court, Horacio Rosatti / web

Provincial Senator / Front of All

Our country is currently experiencing one of the biggest outrages we have seen in relation to the three powers that make up the State. The most serious event was the decision made by the Supreme Court of Justice regarding the co-participation, which directly favored the City of Buenos Aires and called into question the relations between opposition leaders and the members of that court.

What is at stake is the rule of law and it is our duty as representatives of the citizens to expose this situation to avoid the consequences of the Court continuing to advance on the Legislative and Executive powers.

In recent days it has been shown that the Court intervenes, beyond its jurisdiction, in other powers, weakening the political system and democracy. It is not admissible that the head of the Court, Horacio Rosatti, acts like an emperor, like the other judges of the Court, who hold perpetual positions and end up defining the policies of a country by issuing rulings that pass over others powers and their duties.

The ruling delivers funds to the City that, in my opinion, do not correspond to it because they were arbitrarily granted by Mauricio Macri through a decree when he was president of the Nation.

The recent decision of the Court not only affects the province of Buenos Aires but all the provinces. There is a subjugation to the federal question and, therefore, to the form of government that our country adopts.

That is why it seems right to me that President Alberto Fernández put the issue on the table to impeach Rosatti. Although we know that we do not have a sufficient number of legislators in the National Congress to approve the impeachment, it is necessary to build that number. The operation of the Commission will make it possible to cite various characters who are involved in the issue, they will be able to be heard and given public visibility. Making it public is one of the ways that the whole of society can understand why some things happened.

It is not the only case. The influence peddling that we saw with the judges’ trips to Bariloche to meet in Lago Escondido, Silvio Robles’ relationship with the City’s Security Minister, Marcelo D’Alessandro; the unconvicted cases of illegal espionage, the role of judicial operator fulfilled by Pepín Simón, are all signs that there are errors that are committed too frequently to be able to guarantee that the balance of powers is maintained accordingly.

The deficient investigation that was seen after the attack on Vice President Cristina Fernández de Kirchner, with the loss of evidence, the adulteration of a cell phone and the failure to make the necessary connections between those involved and opposition politicians in a case of assassination also talk about institutional deficiencies.

On issues like these, the entire political arc should defend the institutionality. The silences are complicit. Not talking about it or justifying decisions of this type weakens the system in its entirety.

“The recent decision of the Court affects all provinces”
