The Justice granted the request to lift the precautionary measure that suspended the plan “Veredas a la obra”, presented by the Municipality of La Plata. Thus, it will be possible to resume the replacement of tiles that had been questioned by a group of neighbors.
Specifically, the objection in the contentious administrative court No. 1 of Lanús had been made as a result of the removal planned for avenue 7, from 44 to 60, where, according to organizations for the defense of La Plata heritage, “the traditional tiles and placing other white ones of 40 by 40 centimeters, which are not the regulations”.
Works on public roads may continue while the underlying issue is resolved. Until this last resolution of the court of Lanús, the Commune had to stop the works also in Plaza San Martín, the block of the Rector’s Office of the National University of La Plata, the Buenos Aires Legislature and its Annex, the Bank of the Province of Buenos Aires, the Banco Nación and former Banco Municipal, of the Ministry of Economy and Public Works and, also, of the tiles of “memory”.
The head of the Lanús court, Maximiliano Alberto Ceballos, who is on duty, upheld the appeal filed by the Municipality and annulled that precautionary measure that had stopped the works.
According to the terms of the ruling, “the presentation of the Municipality is legitimate”; “the alleged inconsistency in compliance with the current ordinance is equivocal”; and “the information provided by the public officials in charge of the execution of the work seems consistent with the standards they must comply with.”
In response to the patrimonial protection of the sidewalks raised by the plaintiffs, the ruling stated that “those placed by the Commune have the potential to be considered in that condition” and considered that “the preservation, safeguard and protection mandates are not being affected ”.
The Tiles of Memory
Regarding the “Memory Tiles”, the Justice ruled after the reports received, that the “White Tiles” would not be at risk and would not lead to non-compliance with the provisions.
