After the first day of allegations, where both the prosecution and the lawyers for the family of the main victim requested life imprisonment for the eight defendants, on the second day of allegations the defense attorney Hugo Tomei requested the acquittal of those accused of the crime of Fernando Báez Sosa and the argument was that “the fact is not proven”, in the words of the lawyer himself.
Before the president of the Oral Criminal Court No. 1 of Dolores, María Claudia Castro, the eight defendants Máximo Thomsen (23), Enzo Comelli (22), Matías Benicelli (23), Blas Cinalli (21), Ayrton Viollaz (23 ), and Luciano (21), Ciro (22) and Lucas Pertossi (23), said their last words between tears, references to God and everyone asked for “apologies”.
The first to say his final words was Lucas Pertossi, who expressed: “First of all I want to apologize to Fernando’s family, I am very sorry for what happened, I am very bad, very sad for what happened and all the people I affected I want to apologize.” And he added: “I never intended to kill anyone or participate in any murder, not at all. Thanks for listening to me.”
Then Castro gave the floor to Cinalli, who began in the same way: “I want to apologize to all the people affected by what happened, it is something that hurts a lot to this day and is very sad. There was no plan or anything that is said “and he closed:” Thank you for listening to me “.
“First of all, I want to apologize to Fernando’s family because I never wanted this to happen,” began Benicelli, who insisted that he had “no plan or intention to kill anyone” and added: “I think about it every day, every day I am sorry for what happened. I wish I could turn back time, but you can’t anymore. But I want to make it clear that I never wanted to kill anyone.”
Along the same lines as his friends, Ciro Pertossi said: “I wanted to say that I am very sorry for everything that happened. Please (…) apologize to the family for having been there, for having been in a fight where a boy our age died. He is very ugly, I will never want to kill anyone, it is something that affects me a lot (…) Someone our age died, he is very ugly. And he is very ugly of which they accuse us too ”.
At his turn, Viollaz, who was the shortest, said: “I want to apologize to Fernando’s family, I never thought something like this would happen. I am very sorry for everything. Thank you very much for this space that you are giving me, God bless you”.
Thomsen spoke next, speaking his last words through tears and with a cracking voice. “First of all I wanted to apologize to the family, and to all the people who were affected. I would never have thought that something like this could happen (…) It hurts me a lot because a boy our age died and we never had any intention of something like that. I want to apologize, although I know that sometimes they are not enough, but I wish we could go back in time and reverse all this. But we can’t do it, and we have no choice but to apologize. I am very sorry. Thank you for giving me this space and we will always abide by what you decide.
The penultimate to testify was Comelli, who said: “Honestly, I want to apologize to Fernando’s family, also to my family and to all the people who were affected. Unfortunately, due to this aberrational event, in which, as my friends said, a person our age died who had a whole life ahead of him. Really, I want to offer my sincere apologies to everyone involved, which was not only our families and Fernando’s family, but each one of the people who testified and went through this ordeal. I want to thank you for this space, I will always be at your disposal”.
The last to speak was Luciano Pertossi, who said: “First I want to apologize to the family of Báez Sosa and anyone who has been affected by this; say that he never wanted nor did he want to participate in a fight where a person dies. I apologize for everything bad, “and addressing the judges, he added:” I feel that what you say and decide is going to be the right thing. And I pray to God that it’s a good thing for everyone.”
After the last words of the eight defendants, the president of the Oral Criminal Court No. 1 of Dolores set the date of reading the verdict for next February 6 at 1:00 p.m.
