The sentence of the former President of the Republic in the wiretapping case was confirmed on appeal on Wednesday. He was sentenced to three years in prison, two of which were suspended, but will not serve his one-year prison sentence.

The conviction is unprecedented. The sentence of the former French head of state Nicolas Sarkozy in the so-called wiretapping case was confirmed on appeal on Wednesday. He is sentenced, like his historic lawyer Thierry Herzog, to 3 years in prison, including one year. But the former president will not be incarcerated in a penitentiary establishment.

A manageable sentence

Convicted of corruption and influence peddling, Nicolas Sarkozy is the first former President of the Republic to be sentenced to prison. This sentence will however be entirely flexible, according to the details of the magistrate who announced to the former head of state his sentence. This development will result in the wearing of an electronic bracelet.

Nicolas Sarkozy’s lawyer, Me Jacqueline Laffont, however announced that her client had decided to appeal to the Court of Cassation to challenge the decision of the Court of Appeal on the law (and not on the facts). This appeal, which can last one year, is suspensive. As the penalty therefore does not have to be applied during this period, Nicolas Sarkozy will not be equipped with an electronic bracelet in the coming days.

“Nicolas Sarkozy is innocent of the charges against him,” declared Me Laffont. “We will go to the end of the legal path,” she added.

The lawyers of the former head of state have five days to file this appeal, and should take these five days to do so, in order to examine every word, every detail, of the judgment rendered by the court of appeal, to challenge it in law.

The Court of Cassation will then in turn take the time to examine this appeal, which generally takes a year. If the Court of Cassation considers that there is reason to challenge the judgment of the Court of Appeal, then it will announce it in the context of a public hearing, and a court of appeal will have to judge the case again. , on the facts.

Already at first instance, the former president, sentenced to the same sentence, immediately appealed the court’s decision.
