After the end of the objection period, the court awarded BBS1 the contract for the Yellow House on Schalker Meile in Gelsenkirchen. And now?

The rental company BBS1 UG, based in Erkrath, was finally awarded the contract for the house at Kurt-Schumacher-Strasse number 126 by the Gelsenkirchen district court on Tuesday. At the auction of the property, which was in extreme need of renovation and, according to appraisers, ready for scrap, the market value was estimated at one euro. The Gelsenkirchen non-profit housing association actually wanted to bid for the “Yellow House” itself, but was completely surprisingly outperformed by the extremely high BBS1 bidder.

The city has not filed a complaint

The court awarded the contract after the ten-day period from the auction date, which was granted for possible complaints at the request of the city as a creditor regarding outstanding property taxes. A normal process. The ten percent due immediately at the auction, which is to be paid as security in the event of a foreclosure auction, is based on the official market value of the building – but in the case of house number 126 (the half facing Kurt-Schumacher-Strasse) this was only included one euro.

For the significantly more solid part of the house with the number 124, the BBS1 UG was awarded a bid of 616,000 euros. Here, too, the city subsidiary GGW lost out at the auction. The rental company has apparently already paid the required five-digit security deposit for the number 124. Since the buyer has also already settled the – probably quite considerable – outstanding debts with the city of Gelsenkirchen for both properties, as city spokesman Martin Schulmann confirms on request, there is no longer any way to use a security administrator.


BBS1 UG has two months to pay the total amount of both sales. When it came to the company’s liquidity, there were initially doubts from several sides. From now on, the BBS1 should not only enter the building, but also start with the conversions, says Schulmann.

The distribution date for the more expensive, partially rented house number 124, which extends into Uechtingstrasse, has been set by the court for April 26th. Then the Erkrath company has to pay the remaining 580,000 euros. The 125,000 euros for number 126 are due a few days later; two months after receipt of the court’s award letter dated Tuesday, February 14. However, four percent interest is added to the respective sums for the time until the actual payment.

Two more houses on the Schalker Meile will be foreclosed on

This week there will be two more foreclosures of houses on Kurt-Schumacher-Strasse in the Schalker Meile area. One case concerns house number 131 on the opposite side of the street. The four-storey residential and commercial building with two commercial units on the ground floor, three apartments on the upper floors, one apartment on the top floor plus two associated parcels of land are given a total market value of 349,000 euros. The auction begins on Friday, February 17, at 8:30 a.m. in Room 212.

At ten o’clock, in the same hall, the focus is on house number 118, also a residential and commercial building with two commercial units on the corner of Hochkampstrasse. Part of the building erected in 1907 and rebuilt in 1949 is still rented. A market value of 475,000 euros is being called up for this property, which has probably been partially renovated.
