A 23-year-old from Gelsenkirchen is said to have fled from the police in Gladbeck and resisted. Now there was a verdict.

Fleeing from the police, a driver speeds at up to 90 km/h on Schützenstrasse in the direction of the B 224, almost causes a collision when overtaking another vehicle, ignores red traffic lights, accelerates to 130 on the B 224 and on the A 2 up to 200 km/h. Then the police only see his rear lights (WAZ reported).

The crucial question of whether 23-year-old K. was really behind the wheel could not be clarified before the district court in Gladbeck, even after two days of negotiations, neither by testimonies nor by a video taken from the patrol car. Judge Torsten Dostal therefore acquitted him of the charge of dangerous intervention in road traffic.

What is certain is that the accused was found with three other men in the hold of a van during a police check at West Bahnhof. Officers noticed the smell of cannabis but found no drugs. They initially left, but returned some time later, assisted by colleagues in an unmarked vehicle. At that moment, two cars that were parked near the van when it was first used drove off.






It is also certain that some time later police officers were at the door of the defendant’s parental home in Gelsenkirchen. They found the 23-year-old in the children’s room and wanted to secure his cell phone because they had the impression that he wanted to destroy evidence. When he resisted, a physical altercation ensued. A policeman suffered abrasions on his hand. Like his superior on the first day of the trial, this officer did not want to describe the defense of the accused as resistance. “He didn’t try to hurt anyone, didn’t use violence, just didn’t want to give up his cell phone and car keys.”


Judge advises the accused: “Drive carefully in the future.”

On this point, too, the verdict: acquittal. “There is no alternative. Speculations are forbidden. In case of doubt for the accused,” said Judge Dostal in the verdict. He gave the accused the following advice: “Drive carefully in the future.”
