As this newspaper has been publishing, last month’s Court ruling obliges the National Executive to restore the co-participating funds that it took from the City of Buenos Aires in 2020, through a presidential decree. In an extensive letter published yesterday, Fernández reviews the economic measures adopted during the outgoing year, while also celebrating the triumph of the national team in the World Cup in Qatar.

Later he fired directly at the Judiciary and affirmed that during 2022 there has been “an inadmissible advance of it over the rest of the powers of Argentina.” And he referred to a “scandalous link between part of politics and Justice.”

The President maintained that the Council of the Magistracy was “manipulated with unusual interpretations” that allowed the Judiciary to “get involved in the decisions” of the National Congress.

It refers to the ruling that annulled the decision of the president of the Chamber of Deputies, Cecilia Moreau, to back down with the representatives of that Chamber in the Magistracy.

And he argues in the sense of the measure that announces that: “It is my duty to promote actions when the federal system is put in crisis through an unnecessary precautionary measure and the improper proposal of an autonomous city.”

CALL TO GOVERNORS

Next, the president referred directly to the promotion of a political trial against the head of the Supreme Court of Justice, Horacio Rosatti, and the request for an investigation for the rest of its members.

“I have summoned the governors who accompanied the national State in its petition against the Autonomous City of Buenos Aires so that, together, we promote the impeachment of the president of the Supreme Court of Justice, Horacio Rosatti, so that his conduct can be investigated. in the performance of their duties. We will also require that the conduct of the remaining members of the highest court be investigated, ”he advanced.

He also announced that he asked the Minister of Justice, Martín Soria, to file criminal complaints against officials of the Government of the City of Buenos Aires, to investigate whether there were acts of corruption with companies.

“I aspire that in this year that is just beginning, while we are celebrating forty years of democracy, we agree once and for all to build a rule of law in which justice punishes those who are truly responsible without the mediation of pacts. of impunity,” he concluded.

The hard Kirchnerism had been internally demanding Fernández to advance against Rosatti and request his impeachment. The ultra-Christian leader Leopoldo Moreau had defined days ago that the Argentine scenario showed a “conflict of powers” that “is resolved through impeachment of the Court.” And that this jury must be requested by the President because “there is nothing that is prohibited.” And he added that the functioning of the Judiciary presents “a distortion of the system and a vacuum of law.”

The ex-radical had considered that Fernández should intervene because the Court was acting with the intention of “replacing the Executive Power” and “trying to govern” through its rulings.

The vice president, Cristina Kirchner, was recently sentenced to six years in prison and disqualified from holding public office, in the framework of a case that accuses her of embezzlement. But other cases such as those called “Los Sauces” and “Hotersur” remain pending with the Justice.

The ruling party does not have enough numbers in the lower house to succeed in removing Judge Rosatti, although it does place the issue on the political agenda. In Deputies, two thirds are required to approve the accusation and today the ruling party does not even have a simple majority to hold a session.
