Peru incurs contempt by releasing former President Fujimori

LIMA.- The recent release of the former Peruvian president Alberto Fujimori It was considered an act that disobeys the resolutions issued by the Inter-American Court of Human Rights (Inter-American Court), according to a statement released by the court this Thursday.

In its ruling, the Inter-American Court highlighted that the decision of the Peruvian Constitutional Court to release Fujimori on December 6, 2023 constitutes a breach of the supervision resolutions issued by said judicial body. It is worth remembering that the Inter-American Court had urged Peru, on December 6, to wait before executing the order to release the former president, requesting time to analyze whether said decision complied with the conditions established in previous rulings.

Fujimori, 85 years old and affected by various chronic ailments, left prison the same day that the Inter-American Court requested to postpone his release, by virtue of an order from the Constitutional Court that restored a pardon granted in 2017 for humanitarian reasons.

The former president, who faced a 25-year sentence for crimes against humanity in 2009, has suffered from tongue cancer, atrial fibrillation and hypertension, among other medical conditions.

Supervision of the pardon for Fujimori

The Inter-American Court announced that it will carry out reinforced supervision in relation to the obligations to investigate, prosecute and punish serious human rights violations in the case of Barrios Altos and La Cantuta vs. Peru, specifically with regard to the pardon granted to the former Peruvian president.

The legal process surrounding Fujimori has experienced various twists, including the pardon granted in 2017 for humanitarian reasons, its annulment in 2019 by the Supreme Court, and its subsequent reinstatement by the Constitutional Court, which has generated intense debates and analysis in the legal and political sphere.
