Privacy advocates against ChatGPT: Germany initiates proceedings

It was already indicated at the beginning of April, now it is becoming concrete: German data protection officers see a regulatory gap and considerable data protection problems in the artificial intelligence of ChatGPT. Now an official procedure has been opened.

If personal data is used, a legal basis is required according to data protection officials. The users must know if their data is used in AI training programs and accordingly there must be the option to exclude their data from such an evaluation and to object to its use.

“We have drawn up a joint sample letter with questions for Open AI, which most of the state data protection officers will send to the group this week,” the head of the task force explained to the Tagesspiegel. However, Kugelmann is very critical of the approach taken by data protection officers in Italy. Access to ChatGPT had already been restricted there in March under threat of punishment.

AI laws demanded

The data protection authority, Garante per la Protezione dei Dati Personali, accuses ChatGPT, among other things, of not having verified the age of its users. ChatGPT also has “no legal basis justifying the massive collection and storage of personal data” to train the chatbot. However, the rapid development of the technology has not only attracted the attention of users, but also of legislators worldwide. Experts are now calling for a quick response with corresponding new regulations for AIs.
