Prosecutors Diego Luciani and Sergio Mola appealed this Monday the acquittal of the vice president, Cristina Fernández de Kirchnerfor the crime of “illicit association” in the Cause Road and they asked that she also be condemned for that figure.
The prosecutors considered that the decision adopted by majority by the Federal Oral Court number two “rests both on an erroneous interpretation of the corresponding typical requirements, and on an incorrect and biased weighting of the evidence collected.”
According to the appeal, of more than 500 pages, all the defendants “formed and integrated a criminal organization destined to commit crimes.”.
“Their conducts are, respectively, constitutive of the crime of illicit association. To this end, we must state -as has been fully accredited after the exhaustive analysis that we have carried out with respect to each of the tenders that are the subject of this process- that in these proceedings it is not a question of one or two irregular tenders having been carried out” , they pointed out.
Neither is it, they affirmed, “the convergence in the negligent or unscrupulous intervention of one or two officials in the framework of a contract.”
The criminal association worked in a stable and permanent way
“The evidence that has been collected in the trial indicates that the criminal association (which even carried out its criminal plans) functioned in a stable and permanent manner within the state administrative structure and outside of it (through the establishment of of a corporate engineering created and expanded for the purposes sought), and its duration was extended” in time, maintains the resource.

The representatives of the Public Prosecutor’s Office appealed the sentence in relation to the acquittals of the vice president; the former Minister of Planning, Julio Miguel De Vido; the former Secretary of Public Works, José Francisco López, and the former head of the National Road Administration (DNV) Nelson Periotti and the then president of the General Administration of Road Administration of the Province of Santa Cruz (AGVP) Héctor Garro.

Over there, The prosecutors reported that they also appealed “the amount of the confiscation ordered and the dismissal -for extinction of the criminal action due to prescription- regarding the former Secretary of Coordination of Federal Public Works, Carlos Santiago Kirchner, for breach of duties as a public official”.
For prosecutors, the sentence “becomes clearly arbitrary because it is not duly founded and does not constitute a reasoned derivation of the current law applicable to the circumstances of the case.”
“Likewise, it is also self-contradictory in that it presents an ambiguity of such magnitude that it becomes irreconcilable due to its unreasonableness,” they concluded.
