This Monday, January 2, the oral trial begins for the crime of Fernando Báez Sosa committed on January 18, 2020 in the seaside resort of Villa Gesell. The eight rugbiers will try to reject the enormous amount of evidence that proves the participation of each one in the murder.
They all arrive at the trial under the same accusation that provides for a life sentence: “Doubly aggravated homicide due to treachery and the premeditated participation of two or more people” and “minor injuries.” The investigation managed to determine that among the defendants there are two groups that were divided according to the roles they played at the time of the murder.
According to the accusation made by the prosecutor Verónica Zamboni, this is the role of each of the defendants:
– maximum thomsen: he was the one who gave Fernando the final kick to the head and caused “cardiac arrest caused by neurogenic shock due to head trauma.” All the video from the security cameras and from witnesses they filmed place him at the crime scene. The tests corroborated that the victim had marked the rugby player’s shoe on his face, and in turn the shoe had Fernando’s blood. Hours after the crime, he went to eat at a fast food place with Lucas Pertossi as if nothing had happened.
– Cyrus Pertossi: A video obtained from security cameras shows the moment in which he licked his fingers to clean Fernando’s blood. The prosecutor considers him a co-perpetrator of the homicide for having been a participant in the fight since in the line-up they point out that he had been at the crime scene.
– Enzo Comelli: He was in the fight and is considered a participant and even a possible co-perpetrator of the homicide. In the lineup they identified him as one of the first to hit Fernando.
– Matias Benicelli: he participated in the fight and they consider him a participant and possible co-perpetrator of the homicide. The tests confirmed that there was Fernando’s blood on his shirt.
– Blas Cinalli: a swab made of Fernando’s little finger nail revealed that it had his blood, and videos obtained show his participation and the lineup at the Villa Gesell Prosecutor’s Office was key to confirming that he was part of the attack.
– Lucas Pertosi: He was the one who filmed the crime sequence while laughing and asking that no one defend the victim. After the attack, she went to the place where everything happened and sent a message with the word “expired”, alluding to the fact that Fernando had died from the attack. Later, he went to eat at a fast food restaurant with Máximo Thomsen.
– Ayrton Violaz: They believe that he did not hit Fernando, from the videos obtained it is observed that he prevented the victim’s friends from coming to help him.
– Luciano Pertosi: He had the same action as Viollaz and Lucas Pertossi.
Within the group that went on vacation to Villa Gesell there are two of the boys who were released and dismissed from the case for lack of merit, since in the lineup none of the witnesses saw them act against Fernando or his friends or were not even there. at the crime scene. They are Juan Guarino and Alejo Milanesi, who after being released decided not to speak to the press. They will testify in the case as witnesses and there is the possibility that both of them will come across their detained friends.
Pablo Ventura had been framed by the rugby players as participating in the murder but was released a few days after the event and was dismissed in the case since all the evidence provided confirmed that the young man was far from the seaside resort on that date. He is going to testify at the trial.
