The controversy continues over the article that requires motorcycle drivers to take the theoretical-practical course every three years to continue moving through the country’s road corridors even if their driver’s license has not expired.

The discussion began when it was announced that the driving license of these users would go from being renewed every ten years to three, as understood in the draft article. 5.2.27 presented by the Ministry of Transport on April 17, 2023.

After this confusion, the Vice Minister of Transportation, Eduardo Enríquez Caicedo, detailed through a video published on the entity’s Twitter account, the purpose and the real reason for the project of the article presented by the portfolio.

The vice minister specified that The Government seeks to digitize all procedures corresponding to transit and transportation. For this, it published a draft resolution to receive all the comments from the public.

In addition, the vice minister emphasized that the Congress of the Republic in 2020 approved Law 2050, where the theoretical – practical exam must be carried out by motorcycle drivers, at least every three (3) years, according to article 4 paragraph 1.

The official clarified that as it is a law that was approved in the previous Congress and that was processed during the government of Iván Duque, the determination does not correspond to a decision of the “Government of Change”

For this reason, the Ministry of Transportation added that the draft resolution was published with a clear purpose, to allow citizens to contribute their concerns and observations to carry out a review process for that article.

Mr. Biter added that the ministry placed a “mico” in the resolution so that all the more than 10 million motorcyclists must present the Cale, at the established times, not just once as determined in the resolution of August 2022, but every three years.

In other words, by 2022, people only had to take the theory-practice exam if:

  • Driver’s license holders need to recategorize their license.

According to Article 3.7.2.1 “Range of prices” the Cale will charge users for the completion of the theoretical – practical exam the following values:

Category A1 and A2 in UVT: Tax Value Unit

  • Floor rate: 5.25 UVT: minimum value of the exam is $222,663.
  • Ceiling Rate: 6.74 UVT: maximum value of the exam is $285,856.

In turn, to these prices must be added the values ​​corresponding to the National Road Safety Fund, ordered by Article 20 of Law 1702 of 2013, modified by Article 30 of the Law 1763 of 2015; the tax values ​​applicable to the servicethose of financial transaction, for line payments, the rights in favor of the Single National Transit Registry (Runt) and those corresponding to the Control and Surveillance System (Sicov) that the Superintendence of Transportation establishes for the Cale.

Finally, Article 30 of Law 1763 of 2015 specified that:

“In no case may the final rate to the user exceed half (0.5) daily minimum wage in the rates charged by Driver Recognition Centers, Automotive Diagnostic Centers and those who carry out the theoretical-practical test to obtain driving licenses. driving and one (1) minimum daily salary in the Centers of Automotive Education”.
