Doris Vargas burst into tears and was helped by her daughter. There were moments of tension / pain Ripoll

In a day full of commotion and tension in the Oral and Criminal Court No. 5, the trial by juries for the crime of Miguel Heredia, in charge of Judge Carmen Palacios Arias, came to an end with the verdict of “not guilty” decided. by the twelve lay jurors that made up the court.

In this way, the two defendants for “homicide qualified by the premeditated concurrence of two or more people aggravated by the use of a firearm”, Juan Domingo Talerico and Claudio Alexis Torres, would be released in the next few hours, after verification that they do not have impediment to it.

As EL DIA had been reporting in its previous editions, days full of tension were expected at the venue. And so it was: yesterday, a shocking silence began the final arguments of the trial prosecutor, Dr. Silvina Langone, and the lawyer of the injured individual, Martín De Vargas, who toured the evidence produced during the debate, mentioned the false testimonies and ended with some images of the intimate life of the victim Miguel Heredia – who died from a gunshot wound that caused a head injury – that had been recounted by his mother Doris Vargas during her testimony in the trial. In this regard, the defendants’ defense opposed it, stating that these images were not evidence produced throughout the process. But the Judge of TOC No. 5 allowed its use.

Both the Public Prosecutor’s Office and the individual victim emphasized the importance of the role of the jury in decision-making and requested a verdict of “guilty” for the two defendants.

screams and cries

During the final arguments, there were moments full of anguish when Lucas Bianco, Talerico’s defense attorney, argued about issues that had not been declared by the witnesses accusing the victim: “the Heredias came to want to take over the neighborhood. You heard it, there were movements typical of the sale of drugs. The neighborhood changed ”he maintained at the beginning of his defense.

It was at that moment that Doris Vargas, Miguel Heredia’s mother, got up and shouted: “I’m leaving because I can’t listen to this lie. This is not so, I seek justice for my son, not lies. We are working people seeking justice for the death of my son. I have buried my son in the cemetery and I will never see him again. I get on my knees to ask you please,” she said.

The Judge of TOC No. 5 had to request silence on several occasions. Dr. Carmen Palacio Arias stressed that “each of the parties has the right to express themselves based on trial evidence and the others also have the right to respect that, so if they do not remain silent I will be forced to vacate the room.”

But the climate of tension increased and the exchange of words between the parties, the defendants and the defense lawyers finally led the Judge of the Court to make the decision to vacate the room, at which point Vargas fell ill and had to be assisted. by his lawyer and members of the Buenos Aires Penitentiary Service.

After this episode, and a fourth in between, the arguments that later determined the verdict on the defendants continued.

Finally, it is worth mentioning that in the trial for the crime of Miguel Heredia, the jury voted for the “not guilty” of the defendants, thus putting an end to the criminal process since the decision is irrecurrable.
