The President of the Prosecution Commission of the Council of the National Magistracy, Miguel Piedecasasvisited La Plata to meet with the members of the Federal Chamber and in that framework gave a press conference in which he spoke about the work in that body and about the level of vacancy in positions, which is around 50%.
The representative of the legal establishment maintained that the Council of the Magistracy began to function “without impacting the political problem that is being dealt with in the National Congress”. “I think it has been put into operation fully. I was in another stage, before the Court ruling and I had to preside over it. But the truth is that I am surprised for good, with the dynamics, the commitment and the operation that is being given“, he added.
He also explained that due to the meetings of the different areas, they have approved “a large number of files” and that after the meetings of the Accusation Commission “There is progress and progress has been made in different causes”. “I’m also looking at a lot of projects,” she reinforced.
Asked about the vacancies, Piedecasas said that these are being generated continuously and detailed: “With the 14 positions approved by the law to strengthen the Federal Criminal Justice of Santa Fe, we are going between qualified and non-qualified positions at an amount very close to the 1,000 positions in the national and federal justice system”. And he mentioned that between 50 and 60 vacancies are released per yearhence The competitions to cover the positions must be accelerated, because if the shortlists are not raised in sufficient quantities, a liability is left that accumulates.
“That liability is today in the National average at approximately 25%. But in the entire jurisdiction of the Federal Chamber, among the vacancies that are pending in the Council, the vacancies that are in the Senate for its agreement and the vacancies that are in the Executive Power, today we are at 50% vacancies“, he expanded. And added: “We are in a significant number of vacancies and from here I allow myself to make a call to both the national executive power and the Senate to fill this enormous number of vacancies that we have in the jurisdiction “.
Regarding surrogacy, he remarked: “I think that the vacancies are one of the big problems that the justice service has in the Argentine Republic”, and added: “I am in favor of strongly promoting the coverage of vacancies. It seems to me that subrogation should be a provisional solution while they process the contests that must be processed within the regulatory and legal deadlines.” This is because the subrogating judge must occupy part of his time in his natural court and another part in the subrogating court.
On the functions that the Council has in terms of work, Piedecasas listed: “The first is the process of choosing the short lists to raise. The second is the administration of financial economic resources, that is day by day and cannot wait. The third is the disciplinary commission and the accusation commission and the fourth is the regulation”. The lawyer explained that the council has the regulatory power granted by the constitution for the purposes of organizing the Justice agencies and that in matters of discipline and accusation -commission that it chairs- there are meetings every fortnight and work meetings with each from counselors every week. “Today in the accusation commission there is no delay,” he remarked.
