It is news of the last few days that of Vodafone’s record compensation in favor of a (former) customer, compensation equal to almost 200 thousand euros for a story dating back to 2009 and which – evidently – cost the operator dearly. It is in fact the highest compensation recognized in Italy compared to a consumeras underlined by the law firm of Latiano (Brindisi) to which the user has turned.
It was just that Montesardi study – in the persons of Filomeno Montesardi, Margaux Monteardi, Ivana Passaro and Rosalia Longo, all lawyers-partners – to provide details on the incident:
“Our client was unjustly deprived of a right by his telephone operator who for years refused to carry out the judge’s order to reactivate his telephone line unlawfully interrupted“.
In practice, in 2009, the then Vodafone Omnitel it prevented the user “guilty” of having paid a bill one day late from changing manager. Vodafone never provided the migration code necessary, thus causing the loss of the customer’s account that he was forced to change his number.
The whole affair ended up in court and still today it cannot be considered concluded. Vodafone points out that “still hangs the merit judgement before the Court of Brindisi which ordered an official technical consultancy at the end of which the company is confident of being able to definitively clarify the matter”. For the time being, however, the judge has sentenced Vodafone to provide the migration code and pay a fee fine of 20 euros for each day of delay; 50 after the 31st day of default. Total: 200 thousand euros.
They were necessary for the customer to obtain this recognition 12 years, 8 sentences in the various levels of judgment and various appeals. The last pronouncement was issued by the Court of Ivrea (Turin), but the sentence of the Court of Brindisi is still awaited, which will determine the (hopefully) definitive outcome of this whole story.
