Blas Cinalli, one of the eight accused of the crime of Fernando Baéz Sosa, asked to testify before the Oral Criminal Court No. 1 of Dolores. In this context, the person involved denied the charges against him and gave details of the start of a “fight” inside the Le Brique bowling alley in Villa Gesell. He also requested the projection of a video with fragments of interviews conceived by Fernando Burlandowhere the lawyer refers to the youth as “sons of bitches”, “cowards”, “energúmenos”, “eschatological residues”, “shit”, “shit”.
“I want to start by saying that I am very sorry for everything that happened, it was a tragedy, a boy the same age died. There was no plan or anything that is said, no role “Cinalli stated. And she related that on the night of January 18, 2020 “I was dancing with a friend and a girl at the bar, there were so many people that at one point I was left between two rows. I see a round being done on the track, I see a friend who was bent over and a boy who was about to hit him. I approached and grabbed the boy, we were both stranded, we began to struggle, we both fell backwards and when we were able to stop, a patovica grabbed him”complete.
A video was then shown to him, which revealed the presence of Luciano Pertosi in the beating of Fernando. Cinalli identified himself in the images and added: “They grab him, he leaves, he comes back and since he didn’t want to continue fighting, he left”.
Then, Cinalli asked that a series of interviews granted by Burlando be screened, where the lawyer refers to the defendants as “sons of bitches”, “cowards”, “energúmenos”, “eschatological residues”, “shits”, “shit”. “That is what I lived in three years. A lack of respect, not only for my mother, but for all the defendants. I am not going to answer questions to the individual victim. I will respond to the prosecution only what is related to me “said the defendant.
Prosecutor Dávila asks to replay the video of the fight that compromises Luciano. At that moment, he told Cinalli to tell him who are the ones behind the car with him, but he decided not to answer him. “You are talking about another person, did that person ever hit you?”Dávila asked him, to which Cinalli replied: “No, but he was hitting a friend, he was tackling him. In the video it is not seen but he tackles it ”.
According to his account, he saw a friend being grabbed by the waist and foot. “I told him to let go and he grabbed me. He couldn’t get it off. When I do, I kick him. From the skills that I could see, they say that Fernando had my blood on his little finger. I never hit him, I suppose the person I ran into in the bowling alley must have been”he detailed.
Then, they asked him about his chats with his friends. “I think we killed one,” Cinalli said in a text. “It’s what people said,” he excused himself in court. “In the same place where we were, the people who lived there commented on it. I repeated to my friend what he heard. He was not very lucid, what he heard was repeated to my friend. I didn’t think it would have happened, ”he completed.
“What did you talk about on the way home?”asked prosecutor Dávila and Cinalli’s response was: “I don’t remember. Anything at night. bullshit”.
Prosecutors projected another video of the streets of Villa Gesell and again asked him to mark himself with a laser pointer. “There I am, this person is me,” he said. He sees him in the image crossing a street, with two more.
When asked about the moments after the fight, Cinalli said: “At the time I had no dimension of what is happening, for me people were talking about another fight”.
At that moment, Dávila resumed the questioning: “When he says, ‘I think we killed one,’ he means it in the first person. Did you feel anything?”.
Cinalli replies: “I don’t remember the time, it was 6/7 in the morning, I was totally drunk. He didn’t know what he was saying.”.
The lawyer Burlando asked to ask questions but judge Claudia Castro denied them: “The defendant said that he was not going to answer his questions”.
In this way, the stage of receiving testimonies concluded. The prosecution and the complaint will make their arguments on January 25, while the defense will do so on the 26th, after a request made by Burlando.
